On September 25, 2024, a special meeting of Council was convened to address a Motion for the removal of a Councillor due to allegations of disorderly and inappropriate behavior during Council meetings. This conduct significantly undermined the Council’s ability to function effectively, interfered with its business, and damaged the reputation of the Council and its individual members.
The Nation’s Customary Election Regulations, particularly sections 15.4(b) and 15.5-15.7, guided the process, ensuring adherence to principles of credibility, fairness, and respect for tradition.
The 7 Sacred Teachings were central to the proceedings, with witnesses providing their evidence under Nehiyaw oath. Elders attended the meeting in support, further grounding the Council’s deliberations in the Nation’s customary way of handling its internal affairs.
In accordance with Nation’s Law, the Council was required to determine:
The witnesses provided the Council with compelling evidence of the respondent Councillor’s repeated violations of Section 15.4(b), demonstrating a pattern of disorderly and aggressive behavior that undermined the Council’s ability to function effectively. Moreover, their testimony directly supported the Motion by illustrating a consistent pattern of behavior with the allegations.
After receiving all of the relevant evidence presented at the special meeting, the Council deliberated in-chambers before returning with its decision. Based on the evidence and criteria, the Council determined that (1) the alleged incidents had occurred as reported, and (2) the grounds for removal fell within the provisions of Section 15.4(b). As a result, under Section 15.6(c) of the Regulations, the Council was required to remove the impugned Councillor from office, formalized through a Band Council Resolution.
